Water pollution lawsuit against Mountain View, Sunnyvale could change course following Supreme Court ruling

An environmental watchdog is pressing forward with lawsuits against the cities of Mountain View and Sunnyvale in an effort to get them to clean up local creeks. Court filings earlier this year show ongoing disputes between the parties.

"[Mountain View and SunnyVale] claim their creeks are not waters of the United States, he said, and therefore not subject to the federal jurisdiction of the Clean Water Act."

Might be expedient for this case, but this sounds like a very dangerous precedent set by our own cities. No more penalties if anyone dumps raw sewage/pollutants in our local creeks?

I'm really sad to hear that our fair city is trying to shirk it's obvious responsibility to keep us all safe.

Please remember - the City Attorney (or the consulting attorneys) does not make this litigation Public Policy. It is our own elected City Council Members / a majority (4) could completely change the direction! (disconnect form Sunnyvale - and do a settlement agreement)


/ like we will spend $150,00 a year starting to drill and document where that easy-to-test bacteria comes from / and then FIX IT

On 12/5/23, City might pass on consent calendar appropriating 210K from WasteWater Fund....towards litigation expenses (no specific lawsuit mentioned).
Hope that's not the case but it would be tragically ironic if sewer tax money were used not to fix our sewers but to legally defend the Ctiy from Bay Keeper's claims .... of sewer spillage.
