Not quite yet. Kamala Harris is not going to resign as Senator until she is certain to become Vice President. Her elevation to Vice President will be disputed in Congress starting on January 6 and may be in doubt until noon on January 20. As to replacing Senator Harris, state statute allows the Governor (Gavin Newsom) to APPOINT the replacement to occupy a vacated seat until the next statewide election. The Governor does not "nominate" the replacement. However, under a different law (Article V, section 5 of the California Constitution), the Governor would nominate someone to replace Alex Padilla as CA Secretary of State. Governor Newsom has proposed a 72-year-old black assemblywoman in San Diego. Confirmation would be required by both chambers of the CA state legislature. But getting back to my initial point, Republicans Donald Trump and Michael Pence really do intend to steal second terms on January 6. That is why Republican operatives in several swing states gathered together Trump and Pence slates of electors on December 14. These alternative slates have been sent everywhere the state-certified slates for Biden and Harris have been sent - including to Congress which meets in joint session on January 6 - presided over by VP Michael Pence.
