His character has already been destroyed by the publication of his name.
What is the name of the incredible complaining witness?
He will forever be associated with the crime he was arrested for committing, too. If he is stopped for a traffic ticket, they will see that he was arrested for a sexual assault.

If they don't currently have enough evidence to get a conviction, and they file charges now and go to a trail anyway, they won;'t get the conviction and they'll NEVER be able to try him again, even if dna evidence come to light later on. It's certainly not a proclamation of innocence.
If they get dna evidence in 5 months they can charge and convict then instead of just wasting tax payers money on a charges with no evidence to convict.

The DA would have told the police what's missing. Maybe the man will yet be charged. We don't know much. Many posters on the story of the arrest wondered if the woman was a traveling sex worker. Even prostitutes are rightly protected from being rape. Perhaps there will be a third story with more information.
