Gov. Brown signs law reforming state's money bail system

David Quintara, a lobbyist for the California Bail Agents Association said:
"[...] we don't think the government has the right to completely erase an industry"

It is useful to remember that the bail system does not exist to keep bail agents employed. Special interests should never stop us from doing what it right for the public as a whole.

What many people don’t know is that Santa Clara County has had a Pretrial Services Department for nearly 30 years and it is considered one of the top agencies in the nation. They assess everyone who is booked into County Jail for own recognizance release based on the threat to public safety, the probability that they will adhere to any conditions the judge sets for release, and the predicted likelihood they will show up for court. Pretrial Services has worked with tens of thousands of folks booked into County Jail over the past couple of decades and consistently reports an excellent Failure to Appear rate and an above 99% public safety rate, which is much better than the bail industry.

Keeping someone in jail who is low risk just because they can’t make bail is just as wrong as letting out a high risk individual just because they can make bail. Whether or not you can afford money bail has nothing to do with whether or not you are a threat to public safety. That is the reason money bail is losing in the courthouse and the legislature.
