Candidates for Persky's seat steer clear of Turner case

The infamous Brock Turner case is the last thing that two candidates running to replace Judge Aaron Persky want to discuss.

I think the outrage of all this is that sometimes, even tough Brock Turner had this squeaky clean background, it sure did not stop him from doing a totally apprehensible thing to a young woman who was completely passed out. She will NEVER FORGET and it will be with her forever, and just for the severity of this crime, he should have received more time than a mere 6 months.

The new judges won't speak about it because they are judges. If he gets voted out, it sets precedent. They could be in the same boat to boot.

Previous poster said: “She will never forget...” yet she testified, under oath, that she didn’t remember what happened.

Not saying a sexual assualt didn’t happen (no rape occurred per the court and evidence), but she testified she only remembers what people told her. Just saying.

With Judge Persky, his too-lenient-on-Brock-Turner decision was not his only decision too lenient on male perpetrators. If it were just that one decision, recall might not be the right thing. But he has made a number of unfair-to-women decisions. I'm still for the recall.

Nope. Not voting for the recall. Unless a judge acts OUTSIDE THE LAW, I think trying to unseat a sitting judge undermines the American idea of an independent judiciary.

We cannot go around demanding judges act within the law, then try and swap them out when they do, but some don't agree.
This same authoritarian tactic could be used to swap out judges who may or may not support issues on environmental law, or women's reproductive rights.

The laws are being changes to correct the flawed law that existed when Persky issues his sentence. IMO it was too lenient, but all actions taken were well within the law.

I know a cop who admitted he lets a lot of speeders off the hook with a warning. I don't agree and think our speed laws should be rigorously enforced,
but I don't want to kick him off the force simply for using the discretion granted to him by law.

"Concerned Citizen" claims Judge Persky "has made a number of unfair-to-women decisions." However, this is false.

The Commission on Judicial Performance stated Judge Persky’s decisions “do not provide clear and convincing evidence to support the contention that Judge Persky’s decisions reflect personal bias in favor of white criminal defendants and/or more privileged criminal defendants, or that he takes crimes involving violence against women less seriously.”

The Santa Clara County Bar Association’s investigation found “no credible assertion that Persky’s sentence violated the law, that he ignored any ethical obligations or acted in bad faith, or that he had a pattern of egregious conduct that would justify his recall.” The SCCBA found no complaints against Judge Persky during his 13 years on the bench.

The AP, which reviewed 20 of Judge Persky’s cases found, “...no indication of racial bias in the cases where a defendant’s race is listed in court papers (AP, 6/2/18).


Vote NO on the recall.

Hendrickson is for the recall, so she wants to fire a fair and honorable judge who followed the rule of law and the probation officer's recommendation in sentencing Brock Turner. Nope, not voting for Hendrickson.

I'm voting NO on the recall, and if the misguided recall succeeds, I'm voting for Angela Storey. Angela is a sexual assault victim herself, but she is against recall.

These candidates are right to not duscuss a pending case but are engaging in BULL in refusing to say (if they do) whether they would be tougher on rapists than Persky in exercising sentencing discretion. As such, neither candidate deserves anyone's vote. If you wish to engage in BULL, join the rodeo circuit - not the judiciary.

This coward got away with such lenient 6 months due to being white and attending Stanford. Period. If this was a black/brown person he would of been shot at scene. How much did his parents pay Persky? I'm sure Persky got some sort of compensation for this. I'm wondering if this incident happened to the daughter of the people saying NO to the recall would still vote NO on it. Think about it. Facts! YES on recall!

Of course I'm voting NO on the recall. The reasons have all be clearly stated by many and never refuted by the recall group. They just throw out emotionally inflammatory statements, and totally unproven innuendo, preying on people's most "base" emotions.

The clear choice is to vote No on a recall, esp when a judge acts 100% within the law. If the laws are broken, fix them and the judges will continue to act within 100% of the law, with stiffer judgements as dictated by law.

There were witnesses at the scene. What more do you want!?! The fact is he did what he did and should be punished for it. Persky should be held responsible for allowing the sentencing to be what it was. Absolute Joke! If this happened to Persky's daughter I'm sure he would want the sentence to be LIFE w/o parole. VOTE YES!
