Judge issues preliminary injunction blocking sanctuary executive order

Original post made on Apr 25, 2017

A federal judge issued a preliminary injunction in a pair of lawsuits filed by the city of San Francisco and Santa Clara County blocking an executive order by President Donald Trump that threatened to deny federal funding to sanctuary cities and counties.

So will the Republican-controlled Congress next pass a bill authorizing or requiring the President to withhold federal funds for some or any non-compliance with federal laws by state and local governments? President Trump surely would sign such a bill into law. Then what?

You can read the full decision which covers some of these issues. You still run up against the constitutionality of the federal government commandeering state and local resources. The conditions under which they can do that are reasonably well-established. Funnily enough, one of the precedents was set in the case allowing states to opt out of Medicaid expansion under Obamacare. Republicans lauded the opinion then, but we'll see how it's treated with the shoe on the other foot...

I wonder why nobody on Trumps side has addressed the real issue here, that local police handing over immigrants to the federal government will hamper the effectiveness of the local police if immigrants are terrified of reporting criminal behavior for fear of being deported? Police departments have a mandate to protect and serve their local community, and Trump's order is incompatible with that mandate, particularly if immigrant communities also have higher crime rates. Why doesn't that point ever get acknowledged by Trump supporters?

Well once again we have the Weekly working hard at quashing free speech. Already requiring logins to comment on this topic because they don't really want to have a discussion with people who oppose sanctuary cities. Nope. They'll make it difficult to converse so that those viewpoints are not heard. Very sad. And they wonder why Trump accuses the media of bias...

@Alex M - Where are the statistics that show that sanctuary cities are more safe and have less crime than non-sanctuary cities? That argument is hypothetical at best and has no basis in reality. Sanctuary cities are formed to telegraph loudly to illegal immigrants that they are welcome and protected here and serve to encourage illegal immigration (and movement of illegal immigrants from other areas to this area) thus further burdening the local taxpayers. One has to assume that those defending sanctuary cities support abolishing immigration laws since they have no interest in upholding the laws.

Ugh.. why are we so worried about protecting illegal aliens who get here and then continue to break the law?

This isn't some illegal alien who gets here and goes to work, minds their own business.. these are people who are arrested and arraigned.

These are the people who deserve "sanctuary"? Really?

Nonetheless, Trump really need to fight this decision all the way to the Supreme Court. Get this settled one way or another.

The Feds have been using the checkbook to control the states for a long time now. This is not something the Trump administration dream up on January 20th.
