County urges Supreme Court to rule on certain protections for detained immigrants

Twenty U.S. cities and counties led by Santa Clara County have urged the U.S. Supreme Court to rule that immigrants held in prolonged detention during deportation proceedings are entitled to certain constitutional protections.

Let's be clear, the detained immigrants are illegal immigrants, right?

In Santa Clara county, illegal immigrants have more access to free services than legal residents. Why wouldn't I risk coming to the US if I know I'm "entitled" to free benefits- such as education, healthcare, no taxation, and etc. The only benefit as a legal resident is the right to pay more taxes!

Wow, it sounds like being an undocumented immigrant is great. Why haven't you done it yet? It'd be pretty easy to throw away your passport and renounce citizenship.

I agree with Taxpayer. My daughter has a friend who's parents are illegal immigrants. They are nice enough people. But it drives me crazy that the friend gets free meals at school and free bus passes, subsidized medical, and who knows what else? I know I'm paying for that and I also pay for my daughter's meals and bus pass because she is white and doesn't qualify for handouts. How is that fair? I donate, I don't mind helping out, but I would like to choose the recipient. I don't like being forced to take care of an illegal family. It's like illegally robbing Peter to pay Paul, but somehow it is legal? It would be one thing if it was temporary, just to help them get on their feet. But this goes on for years, all through their school years and then on to college scholarships (that are specifically not for whites).

Wow, I guess one benefit of the Trump presidency is that all of the racist dogwhistles have just turned into whistles...

Here's a hint for you, the qualifications for school lunch and bus passes aren't race-based, they're income-based. They get benefits because they're poor, and if they didn't, your daughter's friend might not be able to eat or study at school. But since her parents overstayed their visa, serves her right, I suppose? Better luck next time, kid?

Or, from your perspective, if only your daughter had been lucky enough to be born into a poor, undocumented immigrant family, then, just maybe, she might have a real shot at making it in this world.

I'm not racist and I know that these people are low income. But, you can't help everyone, especially when they don't help themselves. Oh wait, they are helping themselves.

Uh.. the United States Constitution applies to all PEOPLE inside the United States.

If you are against illegal aliens being here, because they broke the law, then you should be fine with the Supreme Court looking at this question and making a ruling ON THE LAW.

I don't think the United States should be able to hold anyone without giving that person due process. That includes access to a lawyer.

@Otto Could not agree with you more (Wikipedia extract from "due process")
The Fifth Amendment to the United States Constitution provides:

No person shall ... be deprived of life, liberty, or property, without due process of law ...[6]

Section One of the Fourteenth Amendment to the United States Constitution provides:

[N]or shall any State deprive any person of life, liberty, or property, without due process of law ...[7]

Guess we are stuck with the original intent of the framers of these Constitutional Amendments. Not so bad, if we don't again try the path of Plessy v. Ferguson, but rather stay the way of Madison.

Little embarrassing to live in such a cold-hearted place. @Resentful - Have you stopped by a food bank? I promise you if you arrive there in need they will give you food, regardless of race. You get white privilege, enjoy it. Our underprivileged get sub-standard food and healthcare, and we get the honor of living in a place that is trying, although not too successfully, to ensure no one goes hungry or sick. People are not illegal, they are undocumented perhaps and usually pay taxes if they can.
