Survey of voters reveals support for recall of Brock Turner judge

Original post made on Jun 28, 2016

A new poll about the potential recall of Santa Clara County Judge Aaron Persky -- whose June 2 sentence of former Stanford University student-athlete Brock Turner for sexually assaulting an unconscious and intoxicated woman sparked an uproar across the globe and on social media over its brevity -- shows how some county residents would vote in an actual recall election.

Well just about everyone agrees that this was terrible judgement on the part of the judge but this should be kick up to a higher court. One big mistake should not result in the judge be fired.

I can already see the villager's torches beginning to dim on this issue. This will be forgotten about by mid summer. What's next to be outraged about and who's job shall we go after when it happens?

I stand in support of Judge Persky as his record shows he is fair, unbiased and knowledgeable. If there is anything in his record to show otherwise it has not been brought forward in this discussion. The legal field is strongly in favor of his retention. We are on the cusp of a new order in California where, because the public has demanded it, courts and probation departments are moving toward less structured and less strict sentencing guidelines. This, because the opposite has only served to fill our jails and prisons with no corresponding drop in crime or recidivism rates. I think in the abstract we all want this new direction. In this case it is too often overlooked that the Judge followed the neutral recommendation of the Probation Department and they are not being vilified for their report. Why him and not them?
And, when if and as Judge Persky is replaced and the new judge renders a decision we again don't like what precedent has been set for us to follow then. The real tragedy in the Brock Turner case is that it happened in the first place. Judge Persky had nothing to do with that. Stanford did and they have done precious little to prevent further recurrences.
