sublease

Original post made by pickapat, another community, on Mar 16, 2015

Hi i am renting a house and even though my lease agreement said that i am not to sublease, i am allowing my brother to stay in the house with out the landlords permission.
He is causing me problems and i have asked him to leave several timesb but he refuses.
The police tell me that since he has been living there for over 4 years he has his rights.
I tried increasing his rent and he refuses to pay the increase. He does not contribute to any of the utility bills, but is sure to use all he desires.
sort of going to court to evict him, what are my options?
Can i packup his personal belongings and place them in a storage unit? can i change the lock on his bedroom door?

In amendment to my post, i meant to say 'short of going to court to evict him, what are my options'

If you change the locks or move his things you are in the wrong.

You will have to evict him which will take at least 2 months. If he refused to leave after getting the eviction, you'll need to get an appointment to have sheriff deputies to evict him which will take about a month, depends how busy they are.

Just move, and let this be the problem of your landlord. Your brother might take the hint.
