Driver arrested in fatal party van crash

The California Highway Patrol arrested the driver of a party van that was involved in a deadly crash on northbound Interstate 280 in Santa Clara County on Sunday night.

Wait a mo'?

How can the driver of the van, who was thrown from the van, be charged with felony HIT AND RUN? DUI and manslaughter I understand but is being thrown from the van considered H&R?
Did he lie about being the driver? or what?

He probably was trying to leave the scene.

If he was DUI, I don't care what they charge him with.
