Mountain View Holiday Inn sued for sexual harassment

The Holiday Inn on El Camino Real near San Antonio Road is being sued by the U.S. Equal Employment Opportunity Commission for allegedly firing a front desk clerk for complaining about being sexually harassed and threatened by her boss.

I applaud Ms. Garcia for taking action despite the consequences. If the alleged claim proves true, then clearly the company is not up to date with the standards on behavior in the work place and require education and training. It's hard to believe there would not be a policy in place by such a large parent company, and if there is, the supervisor should be immediately dismissed. Unfortunately, policies or no policies, certain individuals will still attempt to get away with this type of action. I hope 'zero tolerance' as pointed out by Mr. Tamayo is Holiday Inn's response.

Good for her to stand up to the creeps that are in charge. Why do some people think its okay to treat others in such a degrading manner.

The persons involved should be terminated and not allowed to work in the service industry again

I don't condone sexual harassment. But I also suspect that this lady may be an undocumented immigrant and that may be a factor why the manager thought he could get away with it. Anyways, if immigration laws were violated, the lady needs to be deported immediately and that particulart franchise of Holiday Inn should be punished to the fullest extent allowed by the law. For too long, undocument immigrants have spoiled the quality of life in Mountain View and the surrouding communities. When did America become a country that encourages very profusely to violate all laws? How come businesses violate immigration laws so openly?

"jupiterk", so you're assuming that since the surname of woman involved is Garcia, she is an undocumented immigrant? Highly unlikely. An organization such as the Holiday Inn would require proper documenation during the application and hiring process. Undocumented workers typically work behind the scenes - not front desk receptionist jobs.

Quite a leap from a sexual harassment situation to "deport the illegal immigrant". Unbelievable . . .

I assume Ms Garcia isn't an illegal alien. They tend not to make themselves stand out for fear of being deported, in my experience. Let's hope the court finds the truth so any problems can be fixed quickly.

whaaat?!, you must be very naive to think that undocumented aliens don't do front desk jobs. Holiday Inn is a franchise and they are independently run. yes sometimes, one person/family runs multiple holiday inns and it is not uncommon to see undocumented aliens working at the front desk. mexicans/central americans are not the only undocumented aliens. They come other ethnicities like Asian Indians,Pakistanis,Asians,etc..
That undocumented alien has taken a job of US citizen. Thats all my point. There are couple of violations here. As I said, I don't condone sexual harassment and exploitation under any circumstances.

Jupiterk, you should realize how ridiculous your words are; you're totally convinced that Ms. Garcia is in fact an illegal immigrant. Let me tell you something, for a person to get hired, he/she must demonstrate to possess the skills for said position, she is NOT taking the job from a US citizen as you mention. How do you know if she has become a US citizen herself? She doesn't need to be born in the US to be a citizen.

And yes, you're actually condoning sexual harassment and retaliation since you took on another topic rather than focusing on the issue that this woman is allegedly a victim of unprofessional people.

Sexual harassment is wrong no matter who is the target...or the source.

Jupiterk - An illegal immigrant would not bring exposure to themselves with a public law suit. You're statement is ridiculous.

But back to the point, thank god this is making news. There was recently a law suit against a major bank by an employee stating that she was fired because she was "too hot". Footage later surfaced of this woman, several years prior, on a reality television show talking about how much she loved plastic surgery. Level headed women (and men) who are subjected to this kind of behavior by their supervisors are the ones that need exposure. Not attention grubbing low lives. Way to go Ms. Garcia.

Sexual harrasment is sexual harrasment therefore this behaviour is not acceptable nor legal in this country.We can derail the subjet by using the victims name to open up a whole different discussion but ilegal imigration is not mentioned at all here,Jupitek you sound very curios on the imigration matter and I can only tell you that if you have the belief that ilegal imigrants take the citizen jobs guess what? even if We were to ban all imigrants,Corporations will still travel overseas to hire and explote people from third world so still American citizens wouldnt have the jobs!
In regards to the legit issue lets be realistic sexual harrasment is wrong and if the company is found guilty, well let the system do the job!We as humans must have a better sense of understandment towards the victim.This is a young lady who has decided to stand up for what is rigt,this is not a single incident for this type of sexual harrasment is happening somewhere else in the counrty and her accions only show courage and it sets an example that anyone who is suffering from sexual harrasment is not alone...and can very much report the wrongdoing of "Man and women who use their authority to seek sexual favors"
